Official Rules

The Rayovac Division of Spectrum Brands, Inc. created this award program in an effort to recognize the dedicated Hearing Professionals who have made a difference in the lives of their patients by being committed to helping those with hearing issues.

NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

  1. ELIGIBILITY: This Contest is open only to legal residents of the United States and the District of Columbia who are 18 years of age or older at the time of entry. You need not be present to win. Employees (and their immediate families or those living in the same household) of Sponsor (as identified below), and its respective affiliates, subsidiaries, divisions, parent and related companies, suppliers, printers, judges and advertising and promotional agencies are not eligible to enter or win.
  2. TO ENTER: Contest begins at 12:01 a.m. (CST) on January 2, 2012 and ends at 11:59 p.m. (CDT) on September 30, 2012. You may enter this Contest by completing an Official Entry form available at the following website www.hearingprofessionaloftheyear.com. Entry forms may also be available at your Hearing Professional’s office. You may submit completed entries through the above website or mail them with postage prepaid to: Rayovac Hearing Professional of the Year c/o Hearing Aid Marketing, 601 Rayovac Drive, Madison, WI 53711. Eligible participants may submit as many entries as they wish. No photocopied or mechanically reproduced entry forms will be accepted. Illegible, incomplete or inaccurate entries will be disqualified as will entries generated by script, macro or other automated means. All entries become the property of Sponsor and will not be returned or acknowledged.

    Eligible participants should nominate their hearing care professional defined as Audiologists, Medical Doctors, Licensed Dispensers, and other licensed professionals working in the hearing care field (“Hearing Professional”). Any and all Hearing Professionals practicing in the United States are eligible to win. The participant who submits an entry will hereinafter be referred to as the “Nominator” and the Hearing Professional who the Nominator nominates will hereafter be referred to as the “Nominee”. To enter, follow the directions provided on the entry form (either on the above website or the paper entry form) and complete the entry form including but not limited to composing an essay of (1000) ONE THOUSAND words or less about the Hearing Professional who has made a difference in your life. Self-nominations are not permitted. Include the Nominee’s name, e-mail address and daytime phone number. A Nominator should have the Nominee’s permission to submit the entry.

    Statements must be in keeping with the Sponsor’s image and may not be inappropriate or offensive, as determined by Sponsor in its sole discretion, nor defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any individual’s personal or property rights or any other third party rights. Sponsor reserves the right to disqualify an entry it deems to be offensive, inappropriate, not in keeping with Sponsor’s image or that is otherwise not in compliance with these Official Rules. Each entry must be the Nominator’s original work, and may not have been published previously, entered in any other contest or have won any other award. Submission of any entry grants Sponsor the exclusive right to edit, illustrate, abridge, modify and publish the entry for any and all purposes in any media whether currently in existence or hereafter invented (including but not limited to print and digital media) without compensation to the Nominator or the Nominee.
  3. DESCRIPTON OF PRIZES AND APPROXIMATE RETAIL VALUE: There will be five (5) Grand Prizes awarded to 5 Nominees, one each from the following regions: Northeast Region (Connecticut, Massachusetts, Maine, Michigan, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island and Vermont); Mid-Atlantic Region (Kentucky, Washington D.C., Delaware, Indiana, Maryland, North Carolina, Ohio, Tennessee, Virginia and West Virginia); Midwest Region ( Minnesota, North Dakota, South Dakota, Iowa, Missouri, Nebraska, Kansas, Colorado, New Mexico, Arizona and Wisconsin); South Region (Alabama, Arkansas, Florida, Georgia, Illinois, Louisiana, Mississippi, Oklahoma, South Carolina and Texas); and the West Region (Alaska, California, Washington, Wyoming, Utah, Idaho, Montana, Nevada, Oregon and Hawaii). Each Grand Prize consists of a $500 donation from the Sponsor to the hearing care Not-For-Profit (501© (3)) charity of each winner’s choice and a framed certificate. The total approximate retail value of each of the Grand Prizes is $2500. From the five regional Grand Prize Winners, a national winner (the “National Winner”) will be chosen by the panel of judges and in addition to a Grand Prize the National Winner will designate a hearing care Not-For-Profit (501©(3)) charity to receive a $1000 donation from the Sponsor and a framed certificate. The total approximate retail value of all Grand Prizes and the National Prize is $3500. No transfer, assignment, substitution, or cash equivalent for any of the Prizes is permitted, except by Sponsor in its sole discretion.
  4. PROCEDURE FOR SELECTING WINNERS: All eligible entries timely received will be judged by a panel of qualified judges selected by Sponsor and may include employees of Sponsor, hearing care professionals and hearing industry professionals using equally weighted criteria of: (1) inspirational value of story; (2) clarity of thought and execution; (3) relevance to the theme; (4) originality and creativity and compliance with parameters stated in paragraph 2 above. Judging will be completed by December 31, 2012. The potential Grand Prize Winners and their Nominators will be notified by telephone and/or email by February 28, 2013. The potential National Winner will be notified by telephone and/or email by February 28, 2013. In the event of a tie for the Grand Prize Winner in any of the regions, or for the National Winner, the tied entries will be rejudged by the panel based on the above criteria to determine such Grand Prize Winner or the National Winner.
  5. AWARD OF PRIZES AND PRIZE CONDITIONS: Delivery of the Grand Prizes and the National Prize will be made by March 15, 2013. If necessary due to unavailability for any reason of the Grand Prizes, prizes of equal or greater value may be awarded at the discretion of the Sponsor. All Winners will be required to comply with all instructions in the prize notification letter and may be required to execute and return an Affidavit of Eligibility/Release of Liability/Publicity Release (where permitted by law) within fifteen (15) days of issuance. Failure to return all required documents in this time period may result in a Grand Prize Winner being disqualified and an alternate Grand Prize Winner selected. If a prize notification is returned to Sponsor as undeliverable or if a Winner is found to be ineligible or declines acceptance of the Grand Prize for any reason, an alternate Grand Prize Winner will be selected. By entering this Contest and/or accepting a Grand Prize, Winners and Nominators hereby consent (except where prohibited by law) to the reasonable use by Sponsor of the Winners’ and Nominators’ photographs, voices, likenesses and/or images, hometown addresses, contents of the entry forms and the names of the Winners and Nominators without any further compensation for any future promotional activity related to this Contest. Liability for any applicable expenses not expressly included in the Prizes will be the sole responsibility of the Winners.
  6. GENERAL CONDITIONS OF PARTICIPATION: By entering the Contest, Nominator affirms that he or she has read and agrees to abide by the Official Contest Rules and the decisions of the judges, which are final. By accepting a Grand Prize or the National prize, Nominees and Nominators agree to accept these Official Contest Rules and the decisions of the judges, which are final. Sponsor reserves the right to disqualify any Nominator or Nominee acting in violation of the Official Rules or found tampering with the entry process or with the operation of the Contest or the website. The Contest is governed by the laws of the United States and, by entering; all Winners, Nominators and Nominees hereby submit to the jurisdiction and venue of the federal, state and local courts located in Madison, WI. ANY ATTEMPT BY A NOMINEE OR NOMINATOR OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE RELATED TO SPONSOR OR THE CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH NOMINEE OR NOMINATOR TO THE FULLEST EXTENT PERMITTED BY LAW.
  7. LIMITATIONS OF LIABILITY: Sponsor and its affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees, contractors and agents and the panel of judges (collectively the “Released Parties”) are not responsible for any incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; printing or other errors; and any entries or mail which are late, lost, delayed, incomplete, misdirected, stolen, mutilated, illegible, postage due or any combination thereof. Sponsor reserves the right in its sole discretion to modify, suspend or terminate the Contest and/or the Official Rules at any time without notification in the event that it becomes necessary due to circumstances beyond Sponsor’s control, including but not limited to computer viruses, bugs, worms, tampering, unauthorized intervention, fraud or other technical problems, security, or other problems, events or activities. In the event the Contest, or any part thereof, is terminated early, Sponsor, may in its sole discretion, select Grand Prize Winners and their Nominators from all eligible, non-suspect entries received up to the time of termination. Sponsor also reserves the right not to award all of the Grand Prizes and the National Prize in the event it receives an insufficient number of eligible entries that meet the minimum judging criteria set forth above as determined by Sponsor in its sole discretion. Judges’ decisions in connection with all matters concerning the Contest shall be final and binding.
  8. RELEASE OF LIABILITY: By entering this Contest, each Nominator warrants that his/her entry or entries are original, that the Nominator has each Nominee’s permission to nominate such Nominee and that Sponsor’s use of any material submitted will not violate any rights of any other person or entity, including, without limitation, any copyrights. Each Nominator further agrees to indemnify and hold Sponsor its respective officers, directors, shareholders, employees, contractors and agents and the panel of judges (collectively the “Indemnified Parties”) harmless from any claims arising from Sponsor’s use or possession of Nominator’s submissions. By accepting a Grand Prize, Winners agree that the Indemnified Parties will have no responsibility for any injuries, losses, or damages of any kind resulting from participation in the Contest and/or the acceptance, possession, or use of any prize and Winners and Nominators agree to release, discharge, indemnify and hold harmless the Indemnified Parties from and against any claims made by any Winners or Nominators or any Nominees or other third parties related in any way to the operation of this Contest, as well as any other claims, damages or liability due to any injuries, damages or losses (whether alleged, threatened, or actual) to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest related activity or participation in this Contest.
  9. WINNERS LIST: : The Winners’ List will be posted on www.hearingprofessionaloftheyear.com after February 28, 2013. For a copy of the Official Winners List or a copy of these Official Rules, (please specify) send a self-addressed, stamped envelope to: Rayovac Hearing Professional of the Year c/o Hearing Aid Battery Marketing 601 Rayovac Drive, Madison, WI 53711. All requests must be received by March 31, 2013.
